2. Scope of Application
These Terms and Conditions regulate the use of the FunkyChunky online store and the purchase of products made available through it.
By placing an order, the customer fully accepts these Terms and Conditions.
3. Products and Prices
- All prices are shown in Euros and include VAT at the legal rate in force (unless otherwise stated).
- FunkyChunky reserves the right to change prices, promotions, and conditions without prior notice, without affecting already confirmed orders.
- Product images are illustrative and may not exactly match the delivered product.
- All food products clearly indicate ingredients, allergens, and expiration date.
4. Ordering Process
- The customer selects the desired products and finalizes the order through the shopping cart.
- After confirming the order, the customer receives an automatic email with a summary.
- The order is only considered valid after payment confirmation
5. Payment Methods
- FunkyChunky accepts the following payment methods:
- Multibanco reference (Portugal)
- MB Way
- Credit/Debit Card
- Bank Transfer
6. Deliveries
- Deliveries are made within Portugal Continental and Spain (?)
- The average delivery time is 2 to 5 business days after payment confirmation.
- Shipping costs are displayed before order completion.
- FunkyChunky is not responsible for delivery delays attributable to third parties (carrier, strikes, weather conditions, etc.).
7. Returns and Order Cancellation
According to Portuguese Decree-Law no. 24/2014, article 17(e), customers do not benefit from the 14-day right of withdrawal, since FunkyChunky products are perishable food items subject to rapid deterioration.
However, customers are entitled to:
- File a complaint if the product arrives damaged, defective, expired, or incorrect.
- In such cases, the customer must contact us within 24 hours after delivery by email [insert email], providing the order number and, if possible, a photo of the issue.
- FunkyChunky undertakes to replace the product or refund the purchase price, at no extra cost to the customer.
8. Warranty
- Food products sold by FunkyChunky are covered by the legal conformity warranty, limited to the respective expiration date indicated on the packaging.
- The warranty covers exclusively manufacturing defects, quality issues, or damage occurring during transport.
- Claims will not be accepted in the following cases:
- Improper storage by the customer (e.g., exposure to heat, humidity, or after opening the package).
- Natural changes in flavor or texture over time, provided they remain within the validity period.
- Consumption after the expiration date.
9. Complaints and Dispute Resolution
- Customers may submit complaints directly via email to: info@funkychunkycookies.com
- FunkyChunky provides access to the Online Complaints Book: www.livroreclamacoes.pt.
- Before resorting to courts, customers have the right to attempt to resolve any dispute extrajudicially through the EU Online Dispute Resolution (ODR) platform: https://webgate.ec.europa.eu/odr.
- In Portugal, customers may also contact the Consumer Arbitration Centers: www.consumidor.gov.pt.
10. Privacy and Data Protection
- Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
- Data is used solely for order processing and communication with the customer.
- Customers may at any time access, correct, or request deletion of their data by contacting info@funkychunkycookies.com
11. Final Provisions
- FunkyChunky reserves the right to amend these Terms and Conditions at any time without prior notice.
- The version published on the website at the time of order will apply.
